Procedure for new capacities to be created

From the incremental capacity cycle 2023 - 2025, transmission system operators will charge a fee in accordance with Art. 26 (11) Regulation (EU) 2017/459 (NC CAM) of € 30,000 per market area border, type of request (incremental capacity or capacity to be upgraded) and flow direction for their activities resulting from the transmission of non-binding market demand indications. We would like to point out that the fee will also be charged if the non-binding market demand is not submitted to the German transmission system operators by the enquirer itself, but by a third party (e.g. a neighbouring foreign transmission system operator) (cf. Section 37 BK9-22/042).
